A compliance review should not begin with a finished banner and a request to approve it by lunch. In UK non-broadcast advertising, the creative idea, audience, offer, placement, and landing experience all affect the answer. Review needs to start while those choices can still change.
This playbook summarizes recurring operating themes from the ASA and CAP guidance on gambling advertising. It is not legal advice. Teams should check the current CAP Code, ASA rulings, platform and publisher requirements, licence conditions, and counsel for the exact campaign.
Confirm the market, medium, and owner first
Section 16 of the CAP Code applies to relevant non-broadcast gambling advertising for operators licensed in Great Britain, including marketing by third parties acting for an advertiser. A creator, affiliate, publisher, or agency does not remove the operator from the working chain.
Record the operator, product, licence, target market, audience, channel, publisher, format, destination, offer, campaign dates, and approval owner. If the asset will be adapted across media or markets, treat those versions as separate review objects instead of assuming one approval travels everywhere.
Design for the eligible audience, not around a disclaimer
CAP guidance emphasizes protection of young and vulnerable people. Audience selection, placement context, talent, visual style, language, and product treatment all matter. A small age line cannot rescue creative whose overall appeal or distribution is unsuitable.
Ask who is likely to see the content, not only who the targeting settings intend to reach. Publisher audience composition, shared devices, organic distribution, clips, search visibility, and creator followings can widen exposure beyond the paid target. Document the evidence used to judge the placement.
Test the implication as well as the literal claim
Gambling advertising should not suggest that gambling solves financial or personal problems, is indispensable, proves maturity, or creates sexual or social success. Review the whole execution for those implications. An image, headline, prize treatment, creator reaction, or sequence can create a message the approved sentence never states directly.
Challenge urgency, ease, control, and certainty. Check that qualifying terms are prominent enough for the medium and that the landing page continues the same proposition. If a claim depends on material conditions, the campaign should not make the attractive part immediate and the limiting part practically invisible.
- Claim: what is the reasonable audience likely to understand from the complete execution?
- Evidence: does the operator hold current support for objective product, offer, or performance statements?
- Qualification: are significant terms clear, timely, readable, and consistent at the destination?
Use a review packet and a visible decision log
Send the reviewer the concept, copy, visuals, motion or interaction, format, placement mockup, audience evidence, landing page, offer terms, localization, data logic, and fallback. A static screenshot of the final frame is not enough for a video, interactive unit, or live creator segment.
Record the approved version, reviewer, date, market, conditions, expiry, and any required monitoring. Keep changes linked to the original decision. If a publisher modifies the placement or an offer changes, the team should be able to tell whether the approval still applies.
Prepare a proportionate live response
Name the people who can pause delivery, replace an asset, correct a destination, contact the publisher, and preserve evidence. Set triggers for a broken link, wrong geography, expired offer, inaccurate dynamic state, missing disclosure, or audience concern.
After launch, review representative live placements rather than assuming the trafficked file proves the user experience. Check mobile, common devices, the actual page context, the landing route, and any organic versions. Compliance is an operating process, not a file stamped before trafficking.
